⚖️ IMMIGRATION VICTORY! 🇺🇸

The Immigration Judge GRANTED the application, allowing our client to remain in the United States as a Lawful Permanent Resident.

What is a 42A Application?

42A Cancellation of Removal is a form of immigration relief available to certain lawful permanent residents who are placed in removal proceedings.

Generally, an applicant must show that they:

✅ Have been a lawful permanent resident for at least 5 years
✅ Have resided continuously in the United States for at least 7 years after being admitted in any status
✅ Have not been convicted of an aggravated felony
✅ Deserve a favorable exercise of discretion by the Immigration Judge

Even when someone has a criminal conviction, removal from the United States is not always inevitable. Depending on the circumstances, there may be a defense available.

Today, the U.S. Supreme Court reaffirmed that children born in the United States are U.S. citizens under the Fourteenth Amendment, regardless of their parents' immigration status. The Court rejected efforts to restrict birthright citizenship through executive action and upheld more than a century of constitutional precedent.

⚠️ COMMUNITY ALERT: ICE ACTIVITY REPORTED IN MANATEE COUNTY ⚠️

We have received reports of increased ICE activity in the Manatee County area. If you or your loved ones are undocumented or have concerns about your immigration status, stay alert, remain calm, and know your rights.

KNOW YOUR RIGHTS

✅ If ICE approaches you in public:

You have the right to remain silent.
You do not have to answer questions about where you were born or your immigration status.
You may ask, "Am I free to leave?" If the answer is yes, calmly walk away.
Do not provide false documents or false information.

🏠 If ICE comes to your home:

Do not open the door.
Ask them to slide any warrant under the door or hold it up to a window.
ICE generally needs a judicial warrant signed by a judge to enter your home without your permission. An administrative immigration warrant (Forms I-200 or I-205) does not authorize entry into your home without consent.
You have the right to remain silent.

🚗 If you are stopped while driving:

Provide your driver's license, registration, and proof of insurance if required by law.
You may choose to remain silent regarding your immigration status.
Do not resist or flee.

⛓️ If you are detained:

Remain calm.
Do not sign any documents before speaking with an immigration attorney.
Tell the officer you wish to remain silent and that you want to speak with an attorney.
Do not lie or present false documents.

HELP PROTECT YOUR FAMILY

Have a plan for who will care for your children if you are detained.
Keep important documents in a safe place.
Make sure a trusted family member knows how to contact your attorney.

Remember: Everyone in the United States, regardless of immigration status, has constitutional rights.
