When is the Closing complete?

A real estate “closing” isn’t just signing papers. It’s official only when ALL of the following happen:

1. The Closing Agent has all funds from the Buyer and the Buyer’s lender.
2. The Lender gives the green light with “Funding Authorization.”
3. All signed documents are in the Closing Agent’s hands.
4. All title, lender, and closing conditions are fully satisfied.

Then the Seller must give possession of the property to the Buyer. (Yes, even if it’s too late to send the Seller’s wire! This is bad news I’ve had to deliver more than once! TIP: close early in the day!)

Florida Statute 696.01 mandates that contracts for the sale of real estate can only be recorded if signed by the seller, and also witnessed and notarized, same as a deed.

What can you do with a landlocked parcel of property?

In Florida, an easement by necessity allows someone to use another person's land to access a public road if their property is landlocked. To establish this, the property owner must show that (a) the landlocked parcel and the neighboring land were once part of a single property; (b) the landlocked situation must have been created when the land was divided; and (c) no other legal access exists.

This easement is only granted if there is no reasonable alternative route. Once granted, the easement usually lasts as long as the need exists.

Buying property with someone who isn’t your spouse?
Things can get messy, especially when it comes to disputes over property value and who should be reimbursed for what.

Costs like utilities, internet, and basic upkeep often aren’t reimbursed unless everyone agrees in writing ahead of time.

Before you buy, protect yourself with a Cohabitation Agreement or Tenancy-In-Common agreement. It can spell out who pays what, what’s reimbursable, and what happens if you can’t agree down the road.

Planning ahead is worth it.
