Being organized in the way you approach preparing to be questioned in front of a judge is important, because the information you provide will either strengthen your case or work against you. Ever since the COVID pandemic forced many of our in-person activities online, it has become more and more common for people to appear remotely for Court proceedings. In Colorado, the Courts use a software called WebEx, which is similar to Zoom, and considered to be secure for Court proceedings.

Ever since the COVID pandemic forced many of our in-person activities online, it has become more and more common for people to appear remotely for Court proceedings. In Colorado, the Courts use a software called WebEx, which is similar to Zoom, and considered to be secure for Court proceedings.

I recently wrote about long-distance divorces and how that process normally works. In a divorce with little conflict, it is usually fairly easy for one or both parties to get permission from the Court to appear remotely, making it possible for someone to get divorced without ever leaving the comfort of their home.

However, if a party files a motion to appear remotely and the judge denies it, then that person will still have to fly in and participate in person.

Either party can move to amend or eliminate the protection order as the case proceeds. By way of example, Courts and prosecutors are frequently open to allowing electronic or telephone contact and/or allow contact in public places after things have cooled down.

You can appeal any type of case, including divorce, if there was a significant error involved in the decision-making process. The key word here is “significant.” Sometimes the Courts will find that there was indeed an error, but that it wasn’t significant enough to have affected the outcome of the case.

The topic of Court-ordered gag orders has come up recently in the news as former President Donald Trump makes his way through his numerous Court cases, and continues to receive gag orders.

There are essentially two types of gag orders:

1. A gag order that says you cannot talk about the case during a trial.
2. A gag order that says you cannot talk to the press while a trial is going on.

In Trump’s ongoing fraud trial in New York, Judge Engoron placed a gag order on him after he talked to the press during a recess. The Judge wanted to prevent Trump from publicly identifying those involved to protect their identity and to prevent them from being intimidated, which could affect his/her testimony.
