Business owners, take note! There is a new scam targeting recent trademark applicants.

Someone is emailing from "[email protected]" pretending to be an examining attorney. They are "scheduling" fake calls and asking for your EIN to "save time."

THIS IS A SCAM. The USPTO is a government agency. They do not use Gmail. They will not ask for your EIN via a random email to "finalize registration."

What to do:
1. Block the sender.
2. Do NOT click any files.
3. Report it to the USPTO at [email protected].

The 2026 COPPA amendments introduce the Text-Plus method. It’s no longer just a Yes or No text.

You now need:

1. Confirmed follow-up (text, call, or letter)
2️. Standalone consent for AI training data
3️. A mandatory written information security program

On April 22, 2026, the FTC is officially raising the bar for anyone interacting with minors online. If you think COPPA is just for toy companies, think again.

Do you do any of the following?

• Collect Voice or Video? Even for AI prompts or customer service?
• Use Biometrics? Face IDs, fingerprints, or even gait patterns?
• Ask for Consent via Text? The "Text-Plus" loophole is now strictly regulated.
• Have a mixed audience? Your site isn't just for kids, but kids definitely use it?
• Share Data with AI or Analytics? Non-integral sharing now requires a separate opt-in.

The definition of "Personal Information" has expanded to include Social Security numbers, passports, and genetic data. If you are still using your 2023 Privacy Policy, you are likely out of compliance.
