We’re proud to announce that a case Jeff Loeb tried and prevailed on in the Land Court, Bonanno v. Zoning Board of Appeals of Gloucester, has been affirmed by the Appeals Court and the Supreme Judicial Court declined to hear further arguments

The case turned on standing. Abutters challenged the ZBA's determination that our clients' vacant lot was buildable. The Appeals Court agreed, with a line worth remembering: "neither conjecture nor speculative personal opinion substitutes for proof."

The result: finality for our clients and a clear path to build.

The Plymouth County Superior Court’s decision reinforces an important principle in title insurance coverage, title insurance protects against defects in, liens on, or encumbrances affecting title. It does not generally cover expenses that arise from unrecorded government regulations affecting the use of property.
