: What are the five main types of bail?
Bail is a form of cash, bond, or property provided by an arrested individual to the court, ensuring their appearance as required. The various types of bail include:
➡️Bail with a commercial surety: Offers protection against fraud, misrepresentation, and financial loss, often mandated by federal or provincial courts, government entities, financial institutions, and private firms.
➡️Bail with a secured personal surety: Involves a personal surety meeting Article 311(5) requirements and providing a mortgage on immovable property in Louisiana.
➡️Bail with an unsecured personal surety: Involves submitting an affidavit confirming sufficient state property, detailing work history, and requiring a clean criminal record.
➡️Bail without surety: Allows the defendant to be released on their own recognizance by the judge without a bond.
➡️Bail with a cash deposit: Involves posting the full cash bond at the jail, with the money returned after the case concludes, ensuring the defendant's court appearance.
After setting bail, the defendant can be released by posting bond. If unable to pay the full bond, a bail bondsman can be hired, usually charging a non-refundable fee of 10-12% for assuming the bond risk and putting up the amount.
