Halloween 🎃 is rapidly approaching. That means that young children dressed in costumes (some of which might limit their vision) will be walking, and running around, in unfamiliar areas. Please remember that little children normally don’t understand traffic laws.

Please drive slowly on Halloween and watch out for small children who might dart out into the street. Children are always the future. Please protect them.

It's Halloween tomorrow night and the weather forecast is calling for potential snow bursts and other bad weather. The first snowstorm of the year always catches many drivers by surprise because they find out that they can't stop or control their vehicle as easily when the roads are dry. This presents a dangerous condition when there are a lot more small children crossing the streets. Please drive slower than you normally do tomorrow night and test your stopping capability before you go to far. Driving more carefully than normal is a small price to pay to possible save the life of a child.

File this information in the category under insurance companies are not your friend.

This week I spoke with two senior citizens who were injured in motor vehicle collisions and decided to try to settle their claims for their injuries by themselves. One woman, underwent shoulder surgery and wasn't happy with the settlement offer made by the insurance company so she decided to sue the insurance company on the last day that she could file a lawsuit. Unfortunately for her, she didn't realize that you have to sue the other driver and not the insurance company. The insurance company sent in one of their attorneys who filed a motion to dismiss the lawsuit against them. The Judge granted their motion to dismiss. I had to tell the woman that she waited too long to try to sue the other driver and now her injury claim was finished.

The second person told me that she had settled her relatively small injury case with the insurance company with a verbal understanding that the insurance company was going to pay her medical bills and the $3,000.00 that she was receiving was for her pain and suffering. The woman got a letter from Medicare claiming that they had paid some of her bills were seeking reimbursement of approximately $3,000.00 for those payments. The woman told me that Medicare was seeking the full amount by the end of the month from her or they would start adding interest. I had to tell her that unless the settlement agreement specifically included language that the insurance company was going to pay those bills (which I'm sure the settlement agreement didn't include that language), she was at the mercy of the adjuster for the insurance company to work something out with Medicare.

The moral of these tales is that you can't trust insurance companies to do the right thing for you. They are for profit corporations who don't care about you and are trying to save money on any claim that is made against one of their insureds. I felt bad for both of these senior citizens because they both believed you could still trust people who were part of large corporations.

If you are in one of these situations, consult with an attorney and find out what rights you have, and what you need to know. Don't assume that an insurance company will do what is best for you.

As the first major winter snowstorm approaches, here are some practical tips if you have to drive during the brunt of the upcoming storm: (1) Make sure your vehicle has a full tank of gas and that your tires are in good shape, there is no snow obscuring your head and tail lights and that you have a windshield scraper, snow shovel, bag of salt, bottled water, and blankets in the event that you get stuck; (2) Limit your trips to streets that will be plowed and salted; (3) Even if you have all wheel or 4 wheel drive, assume that it will take you longer to slow down and stop; (4) Drive slower than you normally would on any given road; (5) Drive more defensively than normal and keep a look out for people driving too fast or having a hard time staying in their lane of traffic; (6) If the roads seem really slick due to ice or snow turn on your emergency lights, stay in the right lane if you have more than two lanes of traffic and proceed slowly.

Here’s the importance of taking photos of the accident scene if you are involved in any kind of incident. A semi truck driver was driving south on a four lane street at 6:15 in the morning with the right of way. An SUV pulled out of a side street trying to make a left turn and struck the passenger side of the semi tractor. When the semi came to a stop the driver got out of the semi and took some photos of the damage to the vehicles. The driver of the SUV claimed that the semi jumped the curb and struck the SUV while it was legally stopped at the stop sign. The insurance company for the SUV took the position that their driver was not at fault and offered $500 to settle the truck driver’s claim even though he had $9,000 in medical bills and $4,500 in lost income. At the arbitration of the case, the SUV driver still claimed that semi tractor jumped the curb and struck the stopped SUV. At that point, we showed the arbitration panel a photo that the truck driver took right after the collision. The photo showed the curb which the truck supposedly jumped. The photo demonstrated that the semi never jumped the curb because it would have created deep ruts in the parkway, and there were none. The arbitration panel awarded my client $15,000. They did so because in this case the photo that my client took proved that the other driver was telling a lie. Take photos at the scene of any incident because you never know how important they might become.

Have you noticed lately that a lot of truck drivers don't even honk their horns when they are going to blow a red light at an intersection? Years ago, the more experienced truck drivers would at least honk their horn when they knew they were traveling too fast to stop for a red light. Be safe, always look both ways before you enter an intersection on a green light. It might save your life.
