The 4th Annual Texas Hill Country Legal Seminar will be held on November 14, 2025 at the beautiful Tapatio Springs Hill Country Resort in Boerne. It is sponsored by the Kendall County Bar Association.

I spoke to the Texas Realtors E&O Risk Management Working Group this morning at Texas Realtors HQ in Austin. I talked about arguments being made in court that sections of the Texas Real Estate License Act support imposing vicarious liability on real estate brokers for the acts and omissions of sponsored real estate sales agents. Vicarious liability meaning liability imposed without fault or knowledge on the part of the broker, by virtue of the very relationship itself.

I strongly believe there is no such liability, particularly where there is an independent contractor relationship confirmed by a signed writing. In such a relationship, the broker does not have the right or duty or control the details of the agent's work.

The New Textualism. Conservative justices on the Ohio Supreme Court hold that a reasonable person would not think that "boneless wings" are actually boneless. No, "boneless wings" refers to a "cooking style," not a lack of bones.

This is why we cannot have nice things.

San Antonio attorney Santos Vargas has been elected to be President of the State Bar of Texas! He will be sworn in as President-Elect this June at the State Bar Convention and will serve as President from June 2025 to June 2026.

Santos has an amazing personal story - his father was a migrant farm worker from Mexico and his mother worked as a domestic servant. In his youth, Santos worked with his father as a roofer (and if you have experienced a San Antonio summer you know how hellishly hot it can get). He worked his way through law school to become a distinguished attorney who has well served his profession and the public in a number of capacities - including as a director of our Kendall County Bar Association!

Santos is married to Patricia R. Vargas, who is also his law partner.

Our State Bar will be in very good hands with Santos at the helm.

Diversity, equity, and inclusion are good things, despite the fanatic efforts of some on the right to turn these into bad words.

DEI is about making opportunities open to everyone, and when implemented properly DEI is not in conflict with merit-based hiring and promotions - on the contrary, it promotes merit-based success by increasing the field of qualified candidates.

In 2023, U.S. polling consistently showed strong support for diversity, equity, and inclusion. Will that change in 2024?
