We're proud to share that PKG achieved a significant appellate win in the Ninth Circuit, led by Alex Kruzyk and Bryan Giribaldo!
In a published opinion issued last week, the Ninth Circuit reversed the dismissal of our client's TCPA claims and clarified an important issue in telemarketing law.
The Defendants argued that their calls and text messages were not "telephone solicitations" because they did not expressly advertise any goods or services. The Ninth Circuit disagreed, holding that courts must look at the purpose behind the communications, not just the words used in the messages themselves. The Court found that the Plaintiff adequately alleged the calls and texts were intended to generate customers for real estate brokerage services, allowing the case to move forward.
The decision provides important guidance for TCPA cases throughout the Ninth Circuit, and the rest of the country, and reinforces that businesses cannot evade the TCPA simply by disguising the commercial purpose of their communications.
