If you are a short term rental operator, and you list on sites such as VRBO and AirBNB, one thing that many don’t consider is having an experienced attorney draft a separate booking or occupancy agreement signed with the occupants, separate from the booking page on the platform, especially for higher end rentals. Every hotel has an agreement for booking with their own terms and conditions, why shouldn’t you?
This is often helpful to be able to separately enforce your rights as a host in your state, set your own rules and regulations, and helps to distinguish your booking from a lease, which would implicate a whole host of tenant rights. Without such an agreement, you are at the mercy of the platform’s terms and conditions and state law. If you haven’t already, it might be wise to look into having one drafted by an experienced attorney in this area.
