🚨 BREAKING NEWS 🚨 - The Federal Trade Commission has spoken and said goodbye to non-compete agreements between employers and workers (including, but not limited to employees, independent contractors, and interns). The Non-Compete Clause Rule, 16 CFR Part 910) will go into effect 120 days after the Rule is published in the Federal Register.

Not only does the Rule ban entering into non-compete agreements going forward for all workers, but it also prohibits enforcement of existing non-competes against workers that are not senior executives. Employers must also provide notice to workers that their exiting non-competes are unenforceable following the effective date of the Rule.

Important to note that the Rule does not apply to non-competes entered into by a person pursuant to a bona fide sale of a business entity.

Those are the highlights or lowlights depending on your perspective. The rule should lead to some interesting and strong reactions from attorneys, employers, and employees.
