Had a great time screening Norma Rae at Sidewalk Film with NELA-AL. If you haven’t seen it, check it out on Sunday. Sidewalk is a really cool venue and the movie is a topic I’m all too familiar with, workplace fairness.

Today marks a win for pregnant workers in the US. Effective today, June 27, 2023, employers must provide reasonable accommodations to pregnant workers unless doing so would create an undue burden on the company. This is already being done in many workplaces but now pregnant workers have a concrete roadmap to follow for seeking these protections. Congratulations mommas!

March continues to bring wonderful opportunities to me and the firm. This week I had the honor with my co-counsel Heather Leonard, P.C. of representing an amazingly brave client in a Section 1981 race retaliation case. The jury heard what Davita Key experienced with Dynamic Security, Inc after complaining of discrimination and returned a verdict in her favor for $811,200.

I had the opportunity today to argue on my client’s behalf at the 11th Circuit Court of Appeals. The issues before the court included important considerations that our clients face in discrimination and retaliation cases daily. I’m thankful for a group of strong employee rights lawyers that backed me and a judicial panel that was clearly educated on my case and interested in the issues.

Excited that Congress has added more protections for pregnant and nursing mothers on the workplace.

Read about the new legislation here:

The new rules, included in the latest omnibus package, come as the pandemic has forced employers and the broader public to reexamine how child care disproportionately affects working mothers.

We are seeing an increase in phone calls related to the employee mandates on vaccines. It's important to remember that Alabama is an at will state, our conservative leaders have made certain that an employer can fire you for any reason, good, bad, fair, or unfair, as long as it's not illegal. While the answer is never as simple as "yes" or "no" the guidance has made clear that in many instances mandated vaccines are legal. You can find EEOC guidance on the topic here: https://www.eeoc.gov/coronavirus

As always, disability and religious considerations come into play here, but unless those can be accommodated safely - meaning you are not putting others at risk either - then the employer can likely terminate you for refusal. Flu shots have been mandatory for many in the healthcare field for years.

I'm having a lot of calls from folks that get angry at me and even hang up on me, but the guidance is the guidance. Stay safe, stay informed and as a reminder, my office is requiring masks for any and all in person meetings.

We have established this page to consolidate relevant coronavirus and COVID-19 information and to answer questions from the public about the EEO laws and COVID-19.
