Today, our clients who had been sued in a federal class action lawsuit received great news: a federal judge granted WFL’s motion to dismiss the entire class action. 💪🏼 💪🏼

The world has lost a legal titan. United States District Court Judge Arthur Tarnow was a man who I have admired since I was a boy. My dad, Neil Fink, who spoke at Judge Tarnow’s investiture in 1997, introduced me to him at Tiger Stadium and I have called him one of my heroes ever since. Judge Tarnow was responsible for the creation and success of Michigan’s State Appellate Defender Office, which still exists today and provides elite representation to indigent criminal defendants. As a lawyer, and then a Judge, Judge Tarnow embodied all of the values that made me want to be a lawyer - the same values that I admired about my late father. He believed that the law was the great equalizer, that the power of the government was great, and that the individual mattered. He believed that, for the most part, no person should be judged by their worst acts. And he fiercely defended the Constitution. This is a terrible loss for Judge Tarnow’s family and it is a devastating loss for the justice system. I can say I loved the man for who he was. May his memory be a blessing.

This case has been rightfully criticized for its barbaric result - sending a man in his 20s to die in prison for unintentional conduct, a literal accident. But let me give you direction for your anger: the often unchecked power of state prosecutors. The law that triggered such a lengthy sentence, which should be changed, could have been avoided if prosecutors wished. And such is a prosecutor’s duty. A prosecutor is not merely a robotic observer there to enforce every law as written no matter what. No, a prosecutor has a duty first and foremost to make sure justice be done. For a prosecutor to allow this result is unconscionable. This happens every day. If you want to know who the gatekeepers are - sure, judges, legislators, they all play important roles - but prosecutors are extremely powerful. The ones who don’t appreciate or care about the responsibility that comes with that power are dangerous.

Former Wade Fink Law clerk, Sydney Johnson, was sworn into the bar today. I was honored to be asked to make the motion to a judge on her behalf. Sydney has extraordinary and unique talent and we miss her dearly. Her hard work was a big part of the release of 8 people from federal prison. Good luck at Miller Canfield!
