Two appellate victories. Two important results for our clients.

O'Brien Law Offices is proud to share two recent post-conviction successes.

In the first case, Attorney Jennifer O'Brien successfully argued that an unwanted hug and kiss on the cheek did not satisfy the legal elements of indecent assault and battery. The Appeals Court vacated the client's guilty plea.

In the second case, Attorney O'Brien successfully argued that a client convicted of witness intimidation and threats to commit a crime was denied the effective assistance of counsel. Following an evidentiary hearing, the trial court vacated the client's convictions.

Successful post-conviction litigation is uncommon. Once a conviction has been entered, the law places a significant burden on the defendant to demonstrate that a legal error affected the outcome of the case. These victories reflect the extensive review, legal research, and advocacy required to meet that burden.
