Last week, Kruger Law Firm traveled to Sacramento to LOBBY the Calif State Legislature, Calif Air Resources Board and Governor Newsom’s office on behalf of residents affected by Chiquita Canyon Landfill. See photos below.

Nathan Kruger (Kruger Law Firm) and Nima Sadeghi (Kiesel Law) were honored to join Oshea Orchid (Sethi Orchid Miner), non-profit Citizens for Chiquita Canyon Closure, and Assemblywoman Pilar Schiavo, who all spearheaded the trip, to accomplish the following:

DECLARE A STATE OF EMERGENCY
The LA Board of Supervisors or the Governor need to activate funding that can help residents relocate, manage loans, and cover expensive healthcare costs.

SUPPORT CALIF. ASM. SCHIAVO’S BILLS — AB 27 and 28
The state legislature must approve funding to support these bills that would provide tax relief and State funds for relocation assistance.

STRENGTHEN LANDFILL REGULATIONS
The California Air Resources Board needs to strengthen landfill emissions regulations to protect communities now. Regulators must ensure that landfill operators are held to high standards for controlling emissions.

HONOLULU (Island News) – A Wednesday hearing in Federal court will be significant in determining the venue of hearings of lawsuits against Hawaiian Electric (HECO) and other utilities for damages that were the result of the Aug. 8 Maui wildfires.

This isn't the beginning of litigation. Much had already been accomplished in the fall 2023 to the point that Hawaii State Justice Peter Cahill was ready to set trial dates.

Apparently that was not the position of the defendants as HECO filed for a removal attempting to have the case moved to Federal court. Their motion is based on a statue that evolved from the lawsuits in the wake of Sept. 11.

U.S. District Court Judge Jill A. Otake is hearing arguments regarding the plaintiffs' motion to remand the wildfire cases back to state court on Maui.

“All of the witnesses, critical witnesses, are here on Maui. All the firemen, all the police, all the fire victims are here on Maui,” said Jan K. Apo, lead counsel for the HECO Lawsuit. “And the physical evidence, which in this case involves a lot of the utility poles and the utility equipment, all of which are being stored in huge storehouses right now.”
 Some of those utility poles were just recently made accessible to a HECO Lawsuit investigation team.

“It wasn't until last week that the utility companies allowed us into the warehouse and we got into the warehouse to inspect all the poles and our experts came back with photographs and we did pole inspections and we did termite inspections,” said Apo. “Pole 7A is riddled with termite damage. You see it right off the top. That thing was a termite hive. So the point being is that Hawaiian Telcom and Spectrum (Hawaii) who was using that pole may have a lot more responsibility for this fire than anybody thought at first.”
