Recently, the IRS was granted $79.6 Billion in funding as part of the Inflation Reduction Act of 2022 to bolster taxpayer services and enforcement. This was met with widespread public skepticism that the new funds would be utilized to increase audit and enforcement action, however IRS Commissioner Chuck Rettig stated that “these funds will help us in many areas, including adding critical resources to not just close the tax gap but meaningfully improve taxpayer service and technology."

The IRS's failure to file penalty applies if you don't file your tax return by the appropriate IRS dictated filing due date. The penalty assessed is a percentage of the taxes that a taxpayer would have owed on their tax return had it been timely filed and paid. This penalty is based on how late you file your tax return and the amount of unpaid tax as of the original payment due date (not the extension due date). Unpaid tax is the total tax required to be shown on your return minus amounts paid through withholding, estimated tax payments and allowed refundable credits. Interest is charged on these penalties and can accrue quickly, so it is imperative to file your tax returns timely to stop penalties and interest from adding up.

Willful failure to file a tax return is a misdemeanor pursuant to IRC 7203. In cases where an overt act of evasion occurred, willful failure to file may be elevated to a felony under IRC 7201. Taxpayers charged with a criminal tax evasion can face severe consequences which may include substantial fines and possible jail time. In most instances, the problems faced by non-filers can be resolved successfully if the taxpayer obtains experienced legal counsel and voluntarily addresses the problem. Voluntarily bringing your income tax return filing obligations into compliance can spare you enormous personal and financial costs in the future.
