TN visa status is typically granted for an initial period of up to three years per approval. This allows qualified Canadian and Mexican professionals to work in the United States under a specific employer and approved job role within the TN occupational list.

The status can be renewed multiple times, which makes it possible for professionals to continue working in the U.S. for an extended period. However, each renewal is not automatic and requires proof that the applicant still meets all TN eligibility requirements at the time of extension.

Throughout your stay, it is essential to maintain the same professional role and ensure that your job duties remain consistent with the TN classification. Any significant change in employer, job title, or responsibilities may affect your eligibility and require a new application or visa category review.

Applicants must also continue to demonstrate nonimmigrant intent, meaning the TN visa is intended for temporary work rather than permanent residence in the United States.

πŸ“ŒRaju Law supports professionals in maintaining compliance, handling renewals correctly, and planning long-term U.S. employment strategies based on their immigration goals. Contact us now!

TN status is designed for employment with a qualifying U.S. employer and does not permit self-employment or operating a business in a way that violates TN visa requirements. Professionals who wish to launch, purchase, or actively manage a business in the United States often need to explore a different immigration strategy that aligns with their entrepreneurial goals.

For many investors, the E-2 Treaty Investor visa can provide a pathway to develop and direct a U.S. business through a qualifying investment. Others may consider the EB-5 Immigrant Investor Program, which offers a potential route to permanent residence through a larger qualifying investment that meets specific program requirements.

Each option serves a different purpose and comes with its own eligibility criteria, investment thresholds, documentation requirements, and long-term immigration benefits. Choosing the right pathway depends on factors such as your nationality, investment capacity, business objectives, and whether your goal is temporary work authorization or permanent residency.

Transitioning from a TN visa to an investor-based immigration category requires careful planning to maintain compliance with U.S. immigration laws and avoid disruptions to your status.
