Quick update on the protections offered by the renewed CDC Moratorium on Evictions.
The CDC Moratorium on Evictions is currently in effect in many counties in Oklahoma and will run until, at least October 3, 2021. The important thing to know is that a landlord can still evict a tenant provided the eviction is not related to the tenant's inability to pay rent.
Specifically, if a tenant is engaging in criminal activity on the leased property, threatening the health or safety of other residents, damaging or posing an immediate and significant risk of damage to the rented property, violating any applicable building code, health ordinance or similar regulation relating to health and safety, or violating any other provision of the residential lease agreement (other than timely payment of rent), then a landlord can still proceed to evict the tenant.
If a tenant is going to invoke the protection of the CDC Order, the tenant must provide their landlord with the required CDC Declaration which must be signed under penalty of perjury.
