When inadequate security puts people in danger, the property owner may be held responsible.

Negligent security can involve:

🔹 Broken locks or gates
🔹 Poor lighting
🔹 Missing or inadequate security personnel
🔹 Failure to respond to previous crimes or known threats
🔹 Security cameras that don’t work
🔹 Unsafe parking lots, apartment complexes, hotels, bars, or businesses

If you were assaulted or seriously injured on someone else’s property, the person who harmed you may not be the only responsible party. A property owner or business may also be liable if the danger was foreseeable and reasonable security measures could have helped prevent it.

Every case is different. Contact Lehmbecker Law for a free consultation to learn whether you may have a negligent-security claim.

A dog bit me, but it has never bitten anyone before. Do I still have a claim?

Yes, potentially. Washington does not give a dog owner a ‘one free bite’ rule. RCW 16.08.040 imposes liability for bites when the person was in a public place or lawfully on private property, regardless of the dog’s prior viciousness or the owner’s prior knowledge.

In many cases, a claim may be available if the bite happened in a public place or while you were lawfully on private property. Compensation may include medical expenses, lost wages, pain and suffering, scarring, and other damages related to the attack.

Homeowners or renters insurance may provide coverage for a dog bite claim, depending on the policy and circumstances.

Every case is different, especially if there is a dispute about provocation, where the bite occurred, or who owned or controlled the dog.

If you were bitten by a dog in Washington, documenting the injury, getting medical care, and identifying the dog owner and any available insurance can be important first steps.

Lehmbecker Law represents people injured in dog attacks throughout Washington.

🍂 Fall is officially here — and with it comes darker commutes, wet pavement and slick leaves.

A few extra seconds of caution can make a big difference on the road:

🚗 Slow down, especially on wet or leaf-covered pavement.
↔️ Leave extra space between you and the vehicle ahead.
🚶‍♀️ Keep a close eye out for pedestrians and cyclists, particularly during darker morning and evening commutes.

The autumnal equinox arrives in Seattle at 5:05 p.m. today. Welcome, fall — drive safely out there! 🍁

During Fall Prevention Awareness Week, we’re reminding Washington residents that some falls are not simply accidents — sometimes an unsafe property condition may have contributed to the injury.

FAQ: I fell because of an unsafe condition on someone else’s property. Do I have a claim?

Possibly. In Washington, property owners and businesses may have a responsibility to take reasonable steps to address dangerous conditions on their property.

Examples can include wet or slippery floors, uneven walkways, broken stairs or handrails, poor lighting, debris, unsafe entryways, or other hazards that create an unreasonable risk of injury.

Whether a property owner is legally responsible depends on the facts. Important questions can include whether the owner created the dangerous condition, knew about it, should reasonably have discovered it, or whether the nature of the business made the hazard reasonably foreseeable. Washington courts recognize these concepts in premises-liability cases involving business invitees.

If you are injured in a fall, documenting the condition before it changes can be important. Photos or videos of the area, witness information, an incident report, and prompt medical care may all help preserve what happened.

Lehmbecker Law investigates premises liability and slip-and-fall claims throughout Washington. Consultations are free.

Injured at the fair? What should you document?

Crowds, rides, walkways and parking areas can all create unexpected hazards. If you’re seriously injured at a public event, photograph the condition that caused it, identify witnesses, report what happened and get appropriate medical care.

The Washington State Fair continues in Puyallup through Sept. 27.

Someone from another company caused my work injury. Do I have a claim against them?

Possibly. In Washington, if someone other than your employer or coworker caused your workplace injury, you may be able to pursue a third-party claim in addition to workers’ compensation benefits.

For example, a third-party claim could potentially involve:

🏗️ A general contractor
🚧 Another company working on the site
🔧 A defective piece of equipment or its manufacturer
🏢 A property owner
🚚 Another driver who caused a work-related collision

These cases can be complicated because the workers’ compensation claim and personal injury claim may need to be handled together.

At Lehmbecker Law, we handle BOTH Washington workers’ compensation and personal injury claims, so we can look at the entire accident and determine what sources of compensation may be available.

If you’ve been seriously injured on a construction site, call us for a free consultation.

The insurance company offered me a settlement after my accident. Should I take it?

Maybe — but it is important to understand exactly what the settlement covers before accepting it.

A settlement may be intended to resolve your injury claim permanently, which can mean giving up the right to seek additional compensation later. Before signing anything, it can be helpful to consider whether your medical treatment is complete, whether you know the full extent of your injuries, whether you have lost wages or future expenses, and whether the offer accounts for all of your damages.

Every accident claim is different, and the value of a settlement depends on the facts, the available insurance coverage, and the nature of the injuries.

If you are unsure what an insurance settlement means for your claim, you may want to have the offer reviewed before you sign it.

We can help you understand your options during a free consultation. Feel free to reach out.
