In recent weeks, we have been working with a number of our clients on creating or updating their estate planning documents. These include their Advance Directives--both Healthcare Powers of Attorney and Living Wills. We have found various ways to get their documents witnessed and notarized while remaining socially distant. The speed at which COVID-19 overtook our lives is a good reminder of why having these documents in place is so important for you and your families. Contact us if we can help you develop or update your estate planning documents.

Our practice focuses largely on certain needs of the elderly. Shaine has about twenty years' experience working with various aspects of financial fraud. Most recently she has been serving as Special Counsel to the Liquidator (NH State Bank Commissioner) in connection with recovering funds for victims of a ponzi scheme perpetrated by a public trust company. Sadly, many of the victims of this scheme are elderly. With financial fraud impacting seniors so significantly, our focus is on helping members of that community guard against fraud schemes and trying to recover funds for those who are victims. Shaine also assists individuals to plan for the need to qualify for Medicaid benefits. While it is good to plan ahead, even if you haven't taken steps before you or a loved one are in a nursing home, there are ways in which we can help you. In this month's Parenting NH, I share some thoughts about the importance of estate planning for parents and some of the things that parents need to think about.

It can be uncomfortable to discuss what will happen to our families when we’re gone, but it is important.

Abbe Shaine continues to speak and write on various topics in a variety of settings. Last month she spoke to an audience at a Bedford 55 and up community on the topic of Fraud Prevention, Detection, and Protection. She also spoke to a group at the Osher Lifelong Learning Institute (OLLI) about her experience as Special Counsel, working with the NH State Bank Commissioner to unravel a ponzi and life insurance scheme and recover funds for victims, many of whom are seniors. Next week, she starts teaching a four week class at OLLI exploring a selection of significant historical constitutional law cases. The first class will look at the very timely topic of Separation of Powers, including United States v. Nixon, which discusses Presdent Nixon's attempt to claim executive privilege to shield himself from a subpoena for the Watergate tapes. After a one week break, that class will be followed by a class she will teach focusing on a selection of more recent constitutional cases. Constitutional law is an area of great interest to her.

This article includes insights provided by Abigail Shaine on the subject of whether it is better for a 529 College Savings Account to be opened by a grandparent or for the grandparents to gift those funds for the parents to deposit in a 529 account. It also contains a brief discussion of steps to take to help your child avoid becoming a victim of fraud when they first start earning money. On Friday June 21, Abbe Shaine spoke to the NH Chapter of the Association of Certified Fraud Examiners. Her presentation focused on the work she has performed recently as Special Counsel to the NH State Bank Commissioner as Liquidator of Noble Trust Company, a New Hampshire chartered public trust company. Shaine spoke about how she helped unravel Noble's ponzi scheme and life insurance fraud, working not only with the Bank Commissioner, but with the US Attorney's Office and the FBI. She also described the steps that were taken to recover funds for the victims of this fraud, many of whom were seniors. Shaine plans to offer a similar presentation through the Osher Lifelong Learning Institute during its Fall term.
