What happens when an abuse and neglect case is filed in court?

Abuse and neglect cases begin when a petition is filed in court that alleges the specific acts of abuse or neglect that a parent or caretaker has committed against a child.
The State must prove the allegations of abuse or neglect or the parent can admit to the allegations.
Parents are given time to work on their issues during an improvement period. The goal of abuse and neglect cases is to bring the family back together, so the DHHR will provide services to the family to help move this process along.
There are different types of improvement periods that can be given.
If a parent or caretaker has substantially complied with the DHHR's requirements, then usually the children are reunited with their parents or caretakers.
If the parent or caretaker does not comply, then his or her parental rights can be terminated and the child can be adopted.
This process can take up to 18 months. Unusual cases last longer.

What is an abuse and neglect case?

When the WVDHHR has a reason to believe a parent or custodian has abused or neglected a child, then services will be put in place and/or a court case will be opened. A client asked if he will go to jail in an abuse and neglect case. That’s a good question. The answer is no. Although there can be an criminal action too, the goal of an abuse and neglect case is to help the family work on their issues and bring the family back together. The worst end result is the parent’s rights to the child are terminated.
