Judge Tesla issued a NOT GUILTY verdict as to all criminal charges filed against his client, J.Y.

The District Attorney’s Office came up empty when attempting to get a conviction for DUI against Attorney Benyo's client, J.Y. Attorney Benyo argued Field Sobriety Tests conducted by police did not indicate impairment and blood shot eyes and odor of alcohol only supported JY’s testimony that he had 2 beers after work and hours before encountering police. Judge Tesla agreed and Attorney Benyo won another DUI case saving his client’s driver’s license and jail time. JY now joins a growing list of Attorney Benyo’s clients who have had their DUI charges dismissed or penalties greatly reduced.

In a criminal prosecution it is the responsibility of the Commonwealth through the District Attorney and police to prove guilt beyond a reasonable doubt by presenting evidence to the Court.

K.G. was stopped by police for not switching her turn signal off. Things went from bad to worse when K.G. was then charged with DUI and other crimes. Looking at 3 1/2 to 7 years and the Felony DUI, Attorney Benyo was hired to fight the case for K.G. and review whether evidence of any crime was admissible. End result, the Felony DUI was dismissed and all jail time for the DUI eliminated.

Remember there are rules to follow when criminal cases are investigated. If you are charged in a criminal case, make sure your attorney thoroughly reviews all the evidence before you take a plea. Not all evidence collected by the police is admissible in Court.
