Description of Practice:

The Yarborough Law Firm's practice is directed toward civil, commercial and complex litigation, with the remainder focused on governmental and administrative law. The firm has litigated putative and approved class action cases in the Northern District of California, and Northern District of Florida and the Eastern District of Arkansas, and has also litigated causes of action coordinated as multidistrict litigation under 28 U.S.C. § 1407, including my representation of a putative class and end payors as associate counsel in the In re Automotive Parts Antitrust Litigation currently consolidated in the U.S. District Court for the Eastern District of Michigan. The law firm is presently representing a putative class seeking claims against Chicken of the Sea, Starkist and Bumble Bee Tuna companies concerning antitrust allegations and horizontal price fixing. The putative class is pending the the Southern District of California, San Diego. The firm is also currently litigating numerous cases in federal courts in the Northern District of California concerning regulatory compliance as relates to FDA regulations. Those claims include a presently pending putative class against Coca-Cola in the Northern District of California concerning misbranding of its Coca-Cola products. The firm has litigated numerous cases in federal court in various jurisdictions including the Southern and Northern Districts of Mississippi, the Northern and Southern Districts of Florida, the Eastern District of Louisiana and the Northern District of California. The firm has extensive experience in both federal and state courts related to construction disputes, surety disputes, and issues of professional liability concerning construction projects, as well as litigation of complex pharmaceutical and medical malpractice cases representing plaintiffs, settling some of those cases to allow recovery to clients exceeding one million dollars. The firm's practice has also included representation of prisoners for constitutional violations, and representation of landowners against takings by the State of Mississippi, with issues in those cases including disputes both of the propriety of the taking and damage to remainder of the property. Appellate practice. The firm has served as primary counsel for appeals pending in Mississippi, and in the U.S. Courts of Appeals for the Fifth, Ninth and Eleventh Circuits. The firm has served as primary counsel on five Mississippi state court appeals, argued appeals before a three judge panel of the Fifth Circuit Court of Appeals and a three judge panel of the Mississippi Court of Appeals. In this capacity have lead the fight for over 20,000 automobile dealers in 29 states, victimized by one of the largest price-fixing conspiracies in history.

Yarborough and the Barrett Law Group are presently litigating cases against Opioid manufacturers, distributors and retailers on behalf of hospitals to recoup their losses in multiple states and jurisdictions. Yarborough and BLG are also co-lead counsel in putative class action litigation against Family Dollar due to the rat infestation at the company’s West Memphis distribution center. Lawsuits have been filed in Tennessee, Arkansas, Mississippi, Louisiana, Alabama, and Missouri. Yarborough and BLG are also co-lead counsel in antitrust claims against insulin companies for violations of laws regarding establishment of and charges for insulin products.

Yarborough continues his private practice as Hancock County attorney and other private practice. The Barrett Law Group attorneys manage and litigate complex civil cases across the country.

Related to that litigation, Bumble Bee sought bankruptcy protection in the federal bankruptcy court of Delaware. Yarborough was appointed and served on the five person unsecured creditors committee, which were parties to the $1 Billion Dollar bankruptcy. See In re: Parent Bumble Bee Company, Inc, Case No. 19-12502 (LSS) (Bank. DE 2019). Yarborough serves to protect the interest in that proceeding of not only his putative S.D. California class against Bumble Bee, but also all unsecured creditors.

In one representative matter, Mr. Yarborough was co-counsel in a lawsuit filed against an insurance company for losses related to Hurricane Katrina that resulted in a jury award of nearly $1 million. He has also obtained a $4.9 million jury award in a case brought against Lloyd's of London for its failure to pay out insurance claims. Mr. Yarborough's track record has also included the representation of plaintiffs in complex medical and pharmaceutical malpractice cases, resulting in several settlements in excess of $1 million.

In addition to his private practice, Mr. Yarborough serves as the County Attorney for Hancock County, Mississippi, a position he has held since his 2014 appointment. He also previously served as counsel for the City of Waveland, from 2010 to 2017.

A California federal judge certified six state classes Friday in multidistrict litigation accusing The Coca-Cola Co. of misleading buyers by claiming the soda contains no artificial flavors, but he denied certification to the classes' common law claims.

I’m proud to be appointed to the unsecured creditors committee as to claims against Bumble Bee in its recently filed bankruptcy petition that follows litigation concerning antitrust claims.

Bumble Bee Foods LLC, the largest North American brand of packaged seafood, filed for bankruptcy amid criminal fines and civil lawsuits stemming from a federal price-fixing case with plans for its assets to be acquired by FCF Co. for about $925 million.
