HB 592 is largely a good bill by Louisiana Rep. Beau Beaullieu. But there is a big concern that needs to be addressed:

The Bill (through committee amendment) changes current law to prohibit any legal challenge to a proposed constitutional amendment BEFORE the statewide VOTE on the amendment takes place. This is wrong and should be removed from the Bill. Legal challenges serve to alert the public about both procedural and substantive deficiencies in proposed constitutional amendments. Failed constitutional amendment 2 is a good example of this. The lawsuit that was filed went a long way to raise public awareness about the problems with the Amendment BEFORE the vote, and was certainly a factor in CA2 failing, as it should have. Prohibiting lawsuits in advance of the vote on a proposed constitutional amendment diminishes both government transparency and human liberty.

This amendment needs to be removed from the Bill.
