Art. 3501.1) allows you to petition the Court to convert any past-due support less than 10 years old into an Executory (lump sum) Judgment. Considering filing a child custody or support action in the new year?

Custody and support decrees are never permanent in that they can always be changed, if circumstances justify a change. As the Louisiana 5th Circuit Court of Appeal stated in Duhe v. O’Donnell, child custody arrangements are “not forever binding and may be modified and/or vacated by the Court. Child custody and child support decrees are never final and are always subject to modification.”

In a split (4 to 3) decision, the Louisiana Supreme Court (LASC) recently held that the state 4th Circuit Court of Appeal's affirmation of the trial judge's sentence of 30 years for a 72 year old woman's drug offense conviction is unconstitutional and amounts to "purposeful imposition of pain and suffering". At first glance, most of us might agree but as often is the case, the devil is in the details. After a reading of the decision and the woman's history, where do you fall on this case?
