I have been providing legal advice and legal services to the people of Bardstown, Nelson County and surrounding communities for in excess of a quarter century. I have experience and handle litigation and trial work in the following legal practice areas:

As many of you know, Sara and I have closed down the office on Friday mornings in the Fall for the past five years because we cook and serve lunch to the Bardstown Tiger football team on game days. It is time away from work each week, but it is a labor of love and we feel like we get every bit as much satisfaction out of it as the kids do. If there is a court date on a football Friday, I of course attend that, but we are generally out on Friday mornings until November. I can always be reached by text or email, and we do get back in the office Fridays after 1:30 to return calls. Thank you and GO TIGERS!

Several new calls this week from citizens whom have hired and paid "contractors" to do work for them (pour a patio, build a pole barn, etc.), and the "contractors" either do not do the work, only do partial work and then disappear, or do very substandard work that requires the citizen to start over, at a loss. Unfortunately, the vast majority of these folks never think to obtain a written contract with the "contractor" that has a specific clause allowing them to recover legal fees in the event of the contractor's breach, as well as a clause where the contractor provides a copy of a bond or insurance policy that would answer for damages. A lawyer can usually draft this simple contracts for a few hundred dollars. The client is then shocked when he/she finds out later that, in Kentucky, you can only recover the legal fees you have to spend to hold a contractor accountable for a breach if 1) there is a specific, written contract authorizing recovery of legal fees; 2) the contractor violates a specific statute; or 3) the contractor commits a tortious offense, such as fraud, that would permit recovery. The latter two items can be difficult to establish. Short of one of those 3 things, IT IS VERY DIFFICULT TO GET YOUR LEGAL FEES BACK WHEN SUING A CONTRACTOR/BUILDER. The client is further frequently shocked and dismayed that the contractor/builder didn't have insurance to pay damages, and in their personal capacity doesn't have any money, so the likelihood of getting money back can be low.

Do yourself a favor: hire a lawyer to draft a written contract when you are contemplating spending thousands of dollars on a project. It costs very little when compared to what you may lose in the end.
