⚖️ Legal Term of the Week: Fiduciary Duty ⚖️

A fiduciary duty is a legal obligation requiring one person or entity to act in the best interests of another.

Fiduciary duties commonly arise in relationships involving:

Trustees and beneficiaries
Corporate directors and shareholders
Attorneys and clients
Executors and estates

This duty typically includes responsibilities such as loyalty, honesty, good faith, and reasonable care when making decisions on behalf of others.

Understanding fiduciary responsibilities is an important part of business, estate, and trust matters. Through our affiliate, Maine Fiduciary Services, Rudman Winchell also provides professional fiduciary and trust administration services designed to help individuals and families navigate these important responsibilities with confidence.

✊🏽 Juneteenth ✊🏽

Juneteenth marks the day in 1865 when the last enslaved individuals in the United States were informed of their freedom more than two years after the Emancipation Proclamation was issued.

It stands as a powerful reminder of the ongoing pursuit of equality, justice, and the rule of law.

Juneteenth is a time to reflect on our nation’s history, recognize the progress that has been made, and acknowledge the work that continues.

⚖️ Legal Term of the Week: Arbitration ⚖️

Arbitration is a method of resolving disputes outside of court where a neutral third party, called an arbitrator, reviews the case and makes a decision.

Arbitration clauses are commonly included in:

Business contracts
Employment agreements
Construction contracts
Commercial transactions

Depending on the agreement, arbitration decisions may be legally binding and can sometimes provide a faster or more private alternative to traditional litigation.

Understanding dispute resolution provisions is an important part of reviewing contracts and managing legal risk.
