An estate plan doesn’t necessarily require your assets being probated. A Revocable Living Trust (“RLT”) can also be used to transfer assets at death. The RLT takes the place of a Will and allows assets titled in the name of the RLT to pass automatically at death to the beneficiaries of the trust. Beneficiary designations and joint titling of assets (including a motor vehicle) can also be used to transfer assets without the need for probate. Even though postings have been made each day of this week, this has only been a sampling of the benefits of having an estate plan. How often should you update your estate plan? Use this National Estate Planning Awareness Week to review your current estate plan. If your plan is more than five (5) years old, your marital status has changed, you’ve had children, your wealth has changed, or you otherwise have questions about your current estate plan, call the attorneys at Adelberg Rudow for a review of your current plan. Powers of Attorney, at the least, should be updated on a regular basis so that the age and validity of the appointment is not questioned by a financial institution or medical provider when the Power of Attorney needs to be utilized. Changes can be made to a Will or trust by Codicil or Amendment without necessarily redrafting the entire document. Having a current estate plan can provide for your children from birth through the age of majority and even older, and should change accordingly as the child ages. The estate plan will designate guardians for minor children and the creation of a trust to hold assets passing to a minor. Even after the age of majority, it may be beneficial for a child’s assets to be held in trust. A trustee of your choosing will be appointed to manage and distribute the funds on the child’s behalf. A trust can add certain creditor protections, including from a divorcing spouse, and under Maryland law can last for the lifetime of the child (known as a “Dynasty Trust”). Have you been putting off making your estate plan? Do you believe that you don’t have enough assets to need an estate plan? Maybe you feel you are too young for an estate plan. Perhaps you assume that as a married person, your spouse will just inherit everything. How about the belief that an estate plan is too complicated and expensive? On the third day of National Estate Planning Awareness Week, effort is made to dispel these misconceptions. Frankly, everyone needs an estate plan, regardless of your assets, age or marital status. Without a Will, your assets will pass according to the Maryland laws of intestacy which may be contrary to your wishes. For example, Maryland law does not necessarily provide that all your assets pass automatically to your surviving spouse. Children, including those from a prior marriage, may share in the inheritance of your assets. And without a Will, children may inherit assets that would best be held in trust. On this second day of the National Estate Planning Awareness Week emphasis is placed on the need for a Financial Power of Attorney (appointing an agent to make financial decisions) and Advance Health Care Directive (appointing an agent to make medical decisions). If, during your lifetime, you should become incompetent and unable to make financial or medical decisions on your own, you should have designated persons to make these decisions based upon your stated wishes. Without these executed documents, your family will be required to petition the court and have a guardian appointed who can act on your behalf. This can be time consuming and expensive. October 17th marks the first day of National Estate Planning Awareness Week which continues until October 23rd. In 2008, the National Association of Estate Planners and Councils (NAEPC) worked with Congressional leaders to pass H. Res. 1499, designating the third week of October as National Estate Planning Awareness Week. The purpose of this annual event is to educate the public about the benefits of having an estate plan in the event of disability or death. Only 33% of Americans currently have an estate plan. Surprisingly we read about celebrities who die without Wills and the battle over their estates is played out in the public arena.
