In my experience, the overwhelming majority of people facing charges have agreed to speak with police prior to their arrest. These statements are often used out of context and anything said that points to innocence is intentionally left out of the police report. There are many reasons why a person should remain silent when questioned by police.
You have the right to remain silent. The Fifth Amendment to the U.S. Constitution guarantees that you have the right to remain silent and not to incriminate yourself. This means that you do not have to answer any questions that the police ask you, and you cannot be forced to testify against yourself in court.
Anything you say can be used against you in court. Even if you are innocent, anything you say to the police can be used against you in court. The police are trained to ask questions in a way that will get you to say things that can be used against you. For example, they may ask you leading questions, or they may try to trick you into saying something incriminating.
You are not required to help the police. The police are not your friends, and they are not there to help you. They are there to investigate crimes and to arrest people. You are not required to help them in any way.
It is better to say nothing than to say something that could hurt your case. This applies even if you’re innocent of any wrongdoing. The police may try to pressure you into saying something, but you should not give in. It is better to remain silent and let your lawyer speak for you. I have seen plenty of innocent people charged with serious crimes.
