Remember that under the Texas Property Code (https://statutes.capitol.texas.gov/Docs/PR/htm/PR.92.htm), your landlord can only shut off utility services in the case of a bona fide repair, construction on the property, or for an emergency! Shutting off utilities to account for improperly insulated pipes does not constitute an emergency. Know you're not alone and you have options should this happen to you like it did to this community: https://www.kut.org/austin/2022-12-22/freezing-weather-austin-tenants-rights.

In short, no. According to state law, a landlord cannot shut off utilities without agreement from the tenant unless there is an emergency, repair or construction.

With the freeze coming into Austin, make sure you remember to keep your rental property warm and take care of your pipes!

However, if your landlord has not taken care of their pipes and they burst, don't panic! While there may be flooding in the rental property, you can terminate your lease under the casualty loss provision of Chapter 92 of the Texas Property Code for the issue. HEADS UP: There are some new laws in place regarding fees in lieu of security deposits (what a lot of people call "Sure Deposit". You can't protect yourself if you don't know the law, so check it below, or give us a call for more information if you paid a fee instead of a deposit, and still received a bill from your old landlord.
