Cancer Causing Sun Screens

High levels of benzene—a known carcinogen—have been detected in several popular sunscreens and after-sun care products, including brands such as Neutrogena, Sun Bum, CVS Health, Fruit of the Earth, and Raw Elements.

Benzene is a colorless or light-colored liquid chemical used in petrochemical production and oil and gas refining industries. Exposure to benzene can cause leukemia, lymphoma, and other blood-related cancers, including multiple myeloma. A 2010 review of benzene safety studies found, “There is probably no safe level of exposure to benzene, and all exposures constitute some risk in a linear, if not supralinear, and additive fashion.”

The presence of a cancer-causing chemical in sunscreens is alarming. Several studies have shown that chemicals in sunscreen can enter the bloodstream after they are applied to the skin.

If you or a loved one has developed Leukemia, Lymphoma or other blood-related cancers or diseases after using sunscreen contaminated with benzene, we can help you.

BUSINESS INTERRUPTION CLAIMS

Irvine, California-based In-N-Out Burger joined a growing list of businesses across the country that have filed lawsuits against their insurance companies for refusing to honor business interruption claims due to government-mandated shutdowns to stop the spread of the coronavirus.

In-N-Out Burger filed a breach of contract lawsuit on May 29 in California federal court against its insurer, Zurich American Insurance Co. The company says it suffered “significant losses” when it was forced to shut down its fast food restaurants across the country.

In April, the restaurant filed a claim against its business interruption insurance, a part of a business owner’s policy that provides coverage for payroll, bills, and other operating expenses in the event the business has to temporarily close due to a disaster.

For example, if a restaurant suffered a fire and had to close to repair damages, the restaurant’s business owner’s policy’s commercial property insurance will pay to make repairs to the building and replace inventory damaged. The business interruption portion of the policy would cover operating expenses until the restaurant reopened.

In-N-Out Burger’s policy with Zurich has a $250 million limit. But the restaurant chain received nothing from Zurich. A senior employee with In-N-Out said Zurich’s investigation was “limited to a short email containing a handful of questions regarding COVID-19 diagnoses and the amount of loss.” Zurich denied coverage on May 29, and on that same day In-N-Out filed its lawsuit.

Several restaurants and other businesses across the country have filed similar lawsuits against their insurance companies claiming they have paid on their business owners policies for years and are entitled to coverage for business interruption.

Many small business owners are fighting back and filing lawsuits against their insurance companies for denying coverage they believe they are entitled to. TE Law Offices, P.C. is actively pursuing cases with clients whose insurance companies denied their business interruption claims. We would like to talk to you about any potential claims.

Movement to ban Roundup chemical glyphosate continues.

Glyphosate, the chemical used in the w**d killer Roundup, has been at the center of various lawsuits around the country. Glyphosate has been labeled as a probable carcinogen by the World Health Organization (WHO). The makers of the w**d killer, Monsanto / Bayer, have claimed that their product is safe, though many cities across the country have banned the chemical.

In the wake of the announcement by the WHO and the number of lawsuits, many major cities, have taken a defensive stance against Roundup. Seattle now uses Roundup only as a last resort on w**ds that cannot be tamed and that are required by the state to be removed. However, they are not alone. Portland, Maine; Austin, Miami, and Los Angeles are among other cities that have banned or restricted glyphosate. Boston avoids using glyphosate on an unofficial basis, and New York City may ban Roundup in the future.

The movement to ban glyphosate has garnered international support. Thailand’s Ministry of Agriculture has enacted a ban on agricultural chemicals that include glyphosate, joining neighbor Vietnam. Austria, Malawi, Saudi Arabia, Bermuda, and 10 Canadian provinces have restricted or banned glyphosate. France and Germany (Bayer’s home country) have plans to phase out the product by 2022 and 2023, respectively.

While federal regulators in the U.S. have not taken a stance against Bayer, municipal and county governments continue to pursue glyphosate bans or restrictions of their own.

We are working on cases related to JUUL va**ng addiction.

These devices have been marketed to young people with candy and fruity flavors and promoted as harmless v**er pens. Many young people don’t even know the devices contain a very high amount of ni****ne.

As a result, there has been a large increase in the number of teens using JUUL va**ng devices. Ni****ne is not only addictive; it is harmful to adolescents’ health and brain development. In addition to ni****ne, v**e liquid contains other harmful and carcinogenic chemicals.

We are looking at cases involving adolescent addiction and injuries including seizures, strokes, lung problems, and cardiovascular problems related to the use of JUUL va**ng devices. If you have these type cases, we would like to work with you.

This firm is handling claims involving the popular w**d-killer Roundup.

The active ingredient in Roundup, glyphosate, has been connected to an increased risk of cancer. We are looking at cases of non-Hodgkin's lymphoma after Roundup use. Roundup maker Monsanto was acquired by Bayer AG last year.

There have been two significant plaintiffs wins in these cases:
• In August 2018, a San Francisco Superior Court jury awarded former area groundskeeper DeWayne Johnson $289 million. Mr. Johnson, 46, sprayed Roundup as often as 30 times a day in a four-year span of groundskeeping work.
• In March 2019, a federal jury in San Francisco found that Monsanto’s glyphosate-based herbicide Roundup was “a substantial factor” in causing plaintiff Edwin Hardeman, a 70-year-old Santa Rosa man, to develop non-Hodgkin’s lymphoma. The jury awarded Mr. Hardeman $80 million after deliberating only one day.

We would be happy to talk with you about any potential claims you may have involving Roundup.
