As a member of The Sedona Conference Steering Committee for Working Group 12 on Trade Secrets, BFV shareholder Benjamin Fink has been invited to share his insights during the panel discussion When Continued Possession of Trade Secrets Post-Separation Does or Does Not Constitute Misappropriation of Trade Secrets at the group’s annual meeting in Cleveland, Ohio.

The Defend Trade Secrets Act and Uniform Trade Secrets Act prohibit the improper acquisition, disclosure, or use of trade secrets, but courts have differed on whether continued possession or retention alone is sufficient to constitute misappropriation. The panel will examine the current state of case law and literature on the issue and propose a consensus-seeking solution.
