Kim Jackson and Chris Stastny successfully obtained summary judgment on behalf of an insurer in a first party property action by an insured. The Insurer was successful in demonstrating that Plaintiff's claims were barred by an accord and satisfaction. Plaintiff had sought additional damages due to the carrier’s taking title to a motor vehicle following an accident and property settlement. The court held that Insurer had properly investigated and resolved the total-loss claim, paid the vehicle's lienholder in accordance with the insurance policy and Georgia law, and obtained proper title to the vehicle as part of the parties' settlement.

The Court agreed that Insurer had fully satisfied its contractual and legal obligations, and that Plaintiff's claims arose from a misunderstanding of the settlement.

Because any additional recovery would constitute an impermissible double recovery, the Court granted summary judgment to Kim and Chris’s client on all claims, bringing the litigation to a complete and favorable resolution.

Insurance coverage, super heroes, the paranormal, and AI cause thermos nuclear annihilation ... what do they have in common? Kim Jackson was part of the panel at the 2026 FDCC Annual Meeting in Lisbon, Portugal that put them all together.

Dressed as The Tick, protector of the City and insurance policy language everywhere, Kim helped bring a creative presentation to life, exploring how today's claims professionals can prepare for tomorrow's liability challenges. Using superheroes, villains, monsters, and plenty of policy language, the panel examined how fictional disasters from movies T2, Ghostbuster, and Avengers: Age of Ultron, can spark real conversations about complicated insurance coverage issues, claims handling, extra-contractual exposure, and the future of insurance litigation.

It was a fun, imaginative session that proved even comic book chaos can offer valuable lessons for the legal profession.

We're proud of Kim for bringing both insight and creativity to the discussion!
