The rulings also reinforce that legitimate business transactions and corporate restructuring, standing alone, do not establish a sufficient risk of asset dissipation.

For aircraft brokers, operators, owners, and investors, the decisions underscore that courts will require robust evidence before granting procedural protections or restricting legitimate commercial activity.

With the U.S. Treasury Department's long-awaited employer contribution framework for Trump Accounts now proposed, Smith Gambrell & Russell partner Lisa Carrasco spoke with Bloomberg Law to discuss what the guidance resolved — and what remains unsettled for smaller businesses.

Lisa noted that smaller employers may have a harder time with implementation. Outstanding questions about how contributions will be transmitted, the role of third-party vendors, and forthcoming IRS investment guidance mean many smaller employers are still in a holding pattern. For those eager to move by 2027, Lisa advises considering limiting participation to employer-only contributions to reduce administrative complexity while the regulatory picture comes into focus.
