Changes to HOA's on the way.
Here’s the simple breakdown:

Georgia SB 406 is basically an HOA accountability law. It creates more protection for homeowners and more oversight over HOAs, POAs, and condo associations.

Key changes:

1. HOAs cannot refuse your payment.
If an owner pays, the HOA has to accept it.

2. Payments must be applied in a fair order.
Money goes first to regular dues, then assessments, then fees/fines.

3. Foreclosure is harder for HOAs to start.
The threshold increases from $2,000 to $4,000, and fines/fees generally cannot be counted toward that foreclosure amount. It has to be based on unpaid dues/assessments.

4. Owners get a chance to fix the problem first.
Before attorney fees or foreclosure move forward, the association has to give notice and a chance to cure/pay what is owed.

5. HOAs must register with the Georgia Secretary of State.
They’ll have to provide key information like budgets, governing documents, and officers. If they don’t register, they may lose enforcement powers like collecting fines, filing liens, or foreclosing.

6. There will be a dispute process outside of court.
Homeowners will have a way to bring HOA disputes through the Secretary of State’s office instead of immediately having to sue.

Bottom line:
This law gives Georgia homeowners more protection from abusive HOA practices, especially around fines, liens, attorney fees, and foreclosure. It does not eliminate HOAs, but it makes them more accountable and transparent.

If you are monitoring conversations around smaller housing options, housing flexibility, multigenerational living, and lower-cost housing opportunities in Georgia, HB 1166 is a bill to keep an eye on.

Georgia House Bill 1166 passed the House on March 6, 2026, and is now in the Senate for further consideration.

The bill addresses certain local zoning barriers affecting residential dwellings that are 400 square feet or less and COULD expand options for very small residential dwellings in some parts of the state, depending on the final language and local implementation.

This is one worth watching for anyone involved in Georgia housing, zoning, land use, or residential development.

The parts of real estate you don’t see on HGTV...

It was a sunny afternoon, but the room was heavy. Remnants of a life well lived were everywhere. The home belonged to a hardworking New Yorker I never met, yet somehow knew. The art on the walls and the music that once filled the space told me she loved beauty, creativity, and the classics. Good music.

I was there helping my client, the best friend of the woman who once called this house home, sort through what remained. We sifted through memories that would soon be auctioned or passed on. It was hard work, not just physically but emotionally.

She paused and picked up an item, and the tears came. At first just a few, then all at once. There was nothing to say and nothing to fix. All I could do was offer my arms and let her cry for as long as she needed.

This was only the first step in what we needed to do to prepare the house for sale, but in that moment the house did not matter. What mattered was reassuring her that she could do this and that she would not do it alone. I promised I would be there with her every step of the way.

Because real estate is not always about timelines, staging, or contracts. Sometimes it is about grief, memory, and letting go. Being willing to walk with someone through that quietly, patiently, and with care is a part of this work you do not see on HGTV.
