š° DIVORCING IN GEORGIA? DONāT FORGET ABOUT THE RETIREMENT ACCOUNTS.
A divorce decree may say youāre entitled to a portion of your spouseās retirement benefitsābut that may not be enough to actually get the money.
Thatās where a QDRO (Qualified Domestic Relations Order) may come in.
A QDRO is a specialized court order commonly used to divide certain employer-sponsored retirement plans, such as a 401(k) or pension, after divorce.
āļø Why is a QDRO so important?
Without a properly prepared and approved QDRO:
ā You may have difficulty receiving the retirement benefits awarded to you.
ā The retirement plan may not recognize your right to the funds.
ā Mistakes or delays could create serious problems after the divorce is finalized.
Retirement accounts can be some of the largest assets in a marriage, especially in long-term or high-asset divorces. How those benefits are dividedāand how the settlement documents are draftedāmatters.
