“A Trust can avoid probate.”

You've probably heard that before. But what does that actually mean for your family? 🧐

Consider this scenario: 🎞️🎥

A person's Will says their house should be sold and the proceeds distributed to their heirs. 📜

Sounds straightforward.

❗️But the person named as Executor in the Will doesn't automatically have the authority to begin handling the Estate.

• The original Will must first be filed with the Clerk of Court, and that person must apply to be officially appointed as Executor.

• Once appointed, the probate process comes with additional requirements.

• The Executor is required to file an Inventory listing the Estate's assets. As the Estate is administered, bills are paid, property may be sold, and eventually an Accounting must be filed showing the bills that were paid and what each heir received.

And those Court filings are public record. 👀👀

Now compare that with a properly created and funded Trust.

✅ The Trustee you've appointed does not have to wait to be appointed by the Clerk of Court. The Trustee can step in and begin managing and administering the Trust after your death.

There are no probate Court filings required from the Trustee for the administration of the Trust, allowing the process to remain private. 🔒

And assets that were properly placed in the Trust can be administered outside of probate.

That's what we mean when we say a Trust can avoid probate. 😌

A Will is an important estate planning tool, but depending on your assets and your goals for your family, it may not be the only tool you should consider.

If you've wondered whether a Trust could make things easier for your family someday, schedule an Estate Planning consultation with Ivey & Eggleston Attorneys at Law.

If something happened to you tomorrow, would the people you love know what to do next?

Who would handle your financial affairs? Who would manage your estate? Who could make important decisions if you were unable to make them yourself?

Estate Planning isn’t only about deciding who receives your property one day. A comprehensive plan can also address who you trust to step in and act on your behalf when you can’t.

A will, durable power of attorney, healthcare power of attorney, and other planning tools each serve a different purpose, and the right plan depends on your circumstances.

You don’t have to have everything figured out before meeting with an attorney. That’s what the conversation is for.

August is Make A Will Month! 📝

We plan for vacations, retirement, our children’s futures, and countless other milestones, but one important plan is often left for “someday”.

A will allows you to put your wishes in writing, name who you want to handle your estate, determine how certain assets should be distributed, and nominate a guardian for minor children.

And if you already have a will? This is a great time to ask yourself whether it still reflects your life today.

Marriage, divorce, children, grandchildren, a move, changes in assets, or simply the passing of time can all be good reasons to review your estate plan.

Make a will month is your reminder: don’t leave important decisions to chance.

📄 A will does not automatically keep your estate out of probate.

A will provides instructions for how your assets should be handled after your death, but it generally works through the probate process. A properly created and funded trust, on the other hand, can allow certain assets to pass to your beneficiaries without going through probate.

Why does that matter? Avoiding probate can mean:
⚖️ Less court involvement
🔒 More privacy for your family
⏳ A potentially smoother transition of assets
❤️ Less administrative burden on the people you leave behind

A trust isn’t necessary for everyone—but it may be worth finding out whether one makes sense for you.
