When a loved one passes away, their property and assets may be subject to Probate — a legal process that is required when a person dies with assets in their sole name, with no named pay-on-death or transfer-on-death beneficiary, or a beneficiary so-named dies with that loved one.

Probate is a court-supervised process that can involve many different steps and forms to be followed in order to ensure a deceased person's debts are paid, if applicable, and assets properly distributed to the beneficiaries named in their Will or, if no Will, to their heirs-at-law. A Will does not avoid probate; it is the tool used by a person post-death to indicate the method by which the court will approve a named Executor to serve in that role, and further supervise the distribution of the assets through the Will to ensure they end up being distributed to the proper persons.

Probate is a very serious responsibility to undertake, and mistakes in paperwork or missed deadlines can cause frustrating delays — not to mention potential liability.
