I'm so frustrated with our system. It should not take 6-8 months to get an order or even a court date. People going through a divorce are under immense pressure and stress, because their family is being pulled apart. The last thing they need is to have to wait months for decisions that directly impact their lives. It's unfair and shameful.

The truth I'll tell you as a divorce attorney. ... If you want to save money on your divorce, you need to put on your big boy or big girl pants on, and have the hard conversations with your soon-to-be ex-spouse. Settlement discussions are really important and hard ! But, if you want to save money on fees you need to step it up! The average retainer for a divorce is $5000 to $7,500. That's crazy, and if custody is at issue you're talking about a minimum of $10,000 retainer. So before you complain about your council fees, try to settle some aspects of your case.

Look I'm not going to sugarcoat this for you. If you think you're going to get sole legal custody, you need to think again. In the state of New Jersey sold legal custody is so rare that it's almost a myth. At this point. There would need to be serious substantiated allegations of abuse, mental health issues and actual danger to the child. Neglect or even drug use is not necessarily enough for a judge to remove a parents decision making abilities. And if you want sole custody, absent evidence of actual harm (and even with it), a judge is going to expect to hear from an expert, which can cost $10,000 - $30,000+

The family court isn't designed to be fast. It's an adversarial system. Pitting you against your spouse in a litigation setting. There are areas where the court encourages and even demands mediation, but it's more about moving the case off of their docket than to encourage an amicable resolution.

So mentally prepare for a litigated case to take a year, to a year and a half, even when there's not a lot of fighting. And it's important as you move through the system to take time for self-care!

What happens to our pets in a ?

In NJ even though we consider them family, the courts treat our pets like "chattel" - personal property distributable just like your sofa.

So, if you want to ensure a shared schedule, you better settle that part of your case, because a judge is required to do it.

The truth is- just because you want an uncontested doesn't mean you'll get one. To qualify you BOTH must 1) want to or agree to get divorced; 2) agree on all the issues related to the resolution of your divorce; and 3) be willing to sign a document confirming your agreement.

The truth I’ll tell you as a divorce attorney because you deserve the truth.

If your spouse secretly files a separate tax return, to keep all of their refund and stick you with all of the liability, you don’t have to accept it. You are entitled to either figure out what a joint return would look like and ask for the difference, or you can ask for half of their refund and require them to pay half of your obligation.

Life feels upside down right now. Our country is in chaos. If you're going through a divorce, you're also living through uncertainty regarding what your future holds. It can be even tougher for men, who tend not to talk about their feelings. If that's you, you can sit down and write out a plan with 2-3 priorities and a few items you can live without. And share it with your attorney. It will help you gain control over your situation.

Through these difficult times, life continues to move... Bills need to be paid, you still have to work and children need to go to school, be fed, feel loved.

Be strong, stay safe, you'll get through this.

After 20 years doing this, I can say what's happening in our country right now is not normal. Aside from the obvious tragedies and danger facing people of color and observers attempting to document what's happening, there are real families and children who are being left behind, when their parent(s) are detained or killed. 

That's why every parent, especially of color, must have a power of attorney appointing a trusted adult to step in and make decisions regarding their children's health, safety and welfare, if they are unexpectedly unavailable. Including the simplest tasks, like picking them up from school. 

Parents also need a Will, with a designated guardian. 

These documents are extremely important, for everyone. But especially important for individuals on the front lines of these protests and all people of color (even if you are documented).

question I get - how long is my divorce going to take?

Your unreasonable spouse isn't going to magically be one reasonable and willing to compromise after you file for divorce. I'm not a magician who can suddenly make them willing to compromise and settle your case in 3 months.

I promise I'll get you divorced whether or not they participate in good faith, but it's likely going to take court intervention and more than a couple of months.
