A new federal court decision in one of our cases highlights an important point about wrongful repossessions.

YOUR CAR CAN BE ILLEGALLY REPOSSESSED EVEN IF THERE WAS NO “BREACH OF THE PEACE.”

Our client woke up one morning to discovery her car missing. After calling the police, she discovered that Capital One repo'ed her car, despite the fact that she financed the car through another entity.

About a week later, Capital One allegedly acknowledged that the repossession had been ordered in error and returned the vehicle damaged.

The repossession companies asked the federal court to dismiss the case, arguing in part that there was no alleged breach of the peace.

The Court rejected that argument and allowed our claims to proceed.

Why?

Because a breach of the peace is not the only way a repossession can potentially be unlawful.

If a lender or repossession company never had a legal right to take your vehicle in the first place, the repossession can potentially be wrongful regardless of how peacefully the vehicle was taken.

Wrong car. Wrong person. No valid security interest. No present right to possession.
