Prenuptial agreements. Is there anything so un-romantic?

But they aren't!

A Prenuptial Agreement says our marriage is our own. We don't accept the default way Texas law approaches marital property. During our marriage we want to do something different. And yes, in the unfortunate end in either death or divorce, we don't want to leave our lives up to the whim of a judge or jury. We want to control our own lives.

I can talk to one or both members ( it is best practice for each party to have their own attorney at least review and explain any documents ts) of a couple to lay out their goals.

I have 20 years experience in probate family law and estate planning. Many attorneys specialize more than I have, but staying in all these areas makes me aware of the intersections.

There can be a terrible unintended consequence when divorce and probate tragically interact. Imagine a wife who is ready to divorce. She has developed deep animosity for her husband and is ready to file. Maybe she has even been to the lawyer and filed, but the final decree has not been heard signed and entered. Then imagine the unexpected happens, and she dies.

She is married until the judge says she isn't. If she hasn't changed her will and beneficiary designations in her financial accounts and insurance, the law doesn't distinguish from a husband she hates and a husband she loves. He might get a big payday she never wanted.

Our legal system says people are adults at 18. But few 18 year olds are ready for full adult responsibility.

I can add language to a will which keeps a young adult's inheritance in trust for their benefit until 25, 30 or later so that cooler heads are managing gifts until the young person is older. Call my office to get this in place.

I take my own advice. When we traveled without our children, we designated our adult child to make medical decisions for our minor child.

Thankfully that document wasn't needed then. But it came in handy later when the minor needed a quick sports physical. Both parents were working, but the adult sibling was available.

Powers of attorney and medical powers of attorney are useful beyond estate planning. If you don't have them, call me and we will get them in place.

What if the worst happens? Many of us have godparents who we name for our children at birth. Is this just an honor or are these people you trust your children with if you die?

Parents can name guardians and trustees for their children in their wills. If you don't have a will or your will doesn't make the provisions you want for your children, I can help.

What about kids going to college? Many parents are surprised to find that they can no longer make medical decisions for their 18 and older young adults. If something happens to them without a spouse or medical power of attorney, they are on their own.

Parents need to sit down with their young adult and create a medical power of attorney, designating parents or other responsible adults to make decisions when they can't.

Don't accept the default. If you want to marry, create a martial property agreement that lays out exactly whose is whose. If you don't want to marry, create an estate plan that gives your significant other and other loved ones the exact rights and property you want. A little planning goes a looooong way.
