Not every will must be probated HOWEVER, best practice is to consult an attorney to determine if probating the will is needed in your particular scenario. One has 4 years from the date of Decedent’s death to probate a will. Probating a will is what gives the will effect and, again if needed, appoints an executor to administer the estate of the Decedent. It is MUCH easier (read less expensive) to consult with an attorney within a few months of Decedent’s death than to later attempt to fix things.
