Nobody wants to think about their family fighting over their estate, but it happens more often than you'd think.

The Financial Times tackled this tough question head-on: How can we prevent our children from fighting over our estate?

Here are 4 practical steps mentioned in the article:
โœ… Provide for each child in your will โ€” and explain any unequal treatment in a letter of wishes
โœ… Honor (or address) any promises you've made to a child about specific assets
โœ… Account for past gifts โ€” clarify how prior financial support factors into the estate
โœ… Appoint a neutral or professional executor to avoid any perception of bias

And perhaps most importantly? Have the conversation with your family now, while you still can.

Contact Future Counsel to make sure your estate plan is clear, fair, and built to keep the peace.

The Wall Street Journal just published a timely reminder: estate planning isn't just for the wealthy. If you're over 18, you should read this!

A 2025 Pew Research Center survey revealed that only 32% of adults have a will โ€” that means most people are leaving major decisions about their assets, medical care, and even their children up to the courts.

Here's what every adult should have in place:
โœ… Will
โœ… Durable Power of Attorney
โœ… Healthcare Power of Attorney
โœ… Living Will
โœ… HIPAA Authorization

Without these documents, your family could face lengthy and costly court proceedings just to pay your bills or make medical decisions on your behalf.

We've got your back! Contact us to create or update your estate plan โ€” and make sure YOUR wishes are the ones that get followed.

Read the full article, "The Five Documents You Need to Have in Your Estate Plan" by Robyn A. Friedman in The Wall Street Journal:

These will let you have a say in your medical care, as well as what happens with your assets after you die.

One of the biggest things holding buyers back right now isnโ€™t credit or income, itโ€™s not knowing about the grant opportunities that could help them get there. Many buyers qualify for assistance but never take advantage of it simply because they donโ€™t know where to look or how to apply.

Understanding how these programs work is where many agents can add real value.

Can I Sue the Seller of My Property for Not Disclosing a Problem?

Finding an issue after purchasing a property can be frustratingโ€”but not every situation results in a legal claim.

In many cases, the outcome depends on what the seller knew, what was disclosed, and whether the problem was something a buyer could have identified during the inspection process. Some buyers suspect that the seller may have been aware of the defect but failed to disclose it. A stronger claim may arise when there is evidence of deception or intentional failure to disclose important information.

This blog breaks down the factors that help determine whether you may have a meritorious claim, and what to look for before considering legal action.

Knowing where your situation falls can make a significant difference in how you move forward. Read the blog here: www.futurecounsellaw.com/post/can-i-sue-the-seller-of-my-property-for-not-disclosing-a-problem

If you believe you may have a meritorious claim, Future Counsel can help review the details and discuss your options.

"Do business owners need an estate plan?"

This question goes beyond personal planning, itโ€™s about what happens to the business itself when the owner can no longer run it.

For many business owners, the focus is on growth, operations, and day-to-day decisions. But without a plan in place, questions around control, ownership, and continuity may be left unresolved at a critical time.

This applies across different structuresโ€”whether you operate as a sole proprietor, hold an interest in an LLC, or own shares in a corporation. Each structure carries different implications for how ownership transfers and who has authority to act.

In practice, the real concern is what happens in those moments when decisions still need to be made, but the owner is no longer able to make them.

1. Who steps in to manage the business?
2. How are ownership interests transferred?
3. How does the business fit into the overall estate plan?

Without clear direction, these decisions may fall to default laws or existing agreements that may not fully address the situation. The goal is not just to pass on assets but to ensure continuity, stability, and alignment with the ownerโ€™s intentions.

Future Counsel can help review how your business interests are structured and how they integrate into your overall estate plan.
