🚨 VERY IMPORTANT FOR THOSE APPLYING FOR U.S. CITIZENSHIP (N-400) 🇺🇸
USCIS has now released official guidance explaining how it may conduct “neighborhood investigations” during the naturalization process.
This means USCIS may conduct an investigation outside the immigration office to verify information provided in the application. Investigators may interview people who know the applicant and visit locations connected to the applicant’s residence, employment, or business.
🏠 At or near the applicant’s residence, an investigator may speak with neighbors, landlords, employees or owners of nearby businesses, and even homeowners’ association (HOA) representatives.
💼 At the applicant’s workplace, USCIS may interview supervisors, managers, coworkers, or office staff. If the applicant owns a business or is self-employed, investigators may interview business partners, employees, clients, customers, or contractors.
The investigation may be used to examine or verify matters such as residence history, employment, marriages and divorces, children, travel, criminal history, financial obligations, reputation in the community, credibility, and good moral character.
⚠️ There is something very important applicants should know: USCIS has discretion to WAIVE the neighborhood investigation. Proactively submitting at least two testimonial or character-reference letters with the N-400 can help USCIS determine that a neighborhood investigation is unnecessary. However, submitting the letters does not guarantee that USCIS will waive the investigation.
The letters should preferably come from U.S. citizens who personally know the applicant—such as neighbors, employers, coworkers, or business associates. USCIS does not consider letters from the applicant’s immediate family or relatives for this purpose.
📌 What does this mean in practice?
Applying for citizenship should no longer be viewed as simply completing a form and preparing for the civics and English tests. Everything stated on the N-400 should be accurate, consistent, and capable of being corroborated.
Before filing for naturalization—particularly when there are issues involving immigration history, criminal history, marriages, residence, or employment—it is more important than ever to carefully review the case before filing.
