This Memorial Day, we pause to honor and remember the men and women who gave their lives in service to our country.

Their sacrifice is the foundation of the freedoms we live and work under every day.

At Smithey Law Group, we are grateful for their courage and service, and we take this time to reflect on the true meaning of this day.

Wishing you a safe and meaningful Memorial Day.

Just because you were fired does not mean you cannot get severance.
Many employees assume severance is only for layoffs. That is not always true.

In Maryland, severance is not automatic. It usually depends on:

• An employment contract
• A company policy or past practice
• A collective bargaining agreement
• Certain large layoff situations under federal law

But here is what many people do not realize. Even if severance is not offered, it can often be negotiated.

Employers may be open to negotiation to reduce risk and resolve the situation quickly.

Before accepting or rejecting anything, take time to understand what is being offered and what rights may be affected.

Your job has not ended. But it feels like it is slowly disappearing.

Quiet firing is not a formal termination. It is a pattern of workplace behavior that makes an employee feel pushed out over time.

That pattern can look like:

• Losing responsibilities that once defined your role
• Being excluded from meetings or key decisions
• No feedback, guidance, or performance reviews
• Shifting expectations that are hard to meet
• Isolation from your team or leadership

On its own, each change may seem small. Together, they can signal something bigger.

Quiet firing is not automatically illegal. But when it is tied to discrimination, retaliation, or protected leave, it can raise legal concerns.

If your workplace suddenly feels very different, it may be worth paying closer attention. Learn more: https://smitheylaw.com/what-is-quiet-firing/

A former employer says something about you, and suddenly, job offers disappear. What now?

Not every negative comment is illegal. But if an employer makes a false statement presented as fact that harms your reputation, it may rise to defamation under Maryland law.

To bring a claim, you generally need to show:

• A false statement of fact, not opinion
• That the statement was shared with someone else
• Fault by the employer
• Real harm, such as lost job opportunities or income

These cases can be difficult because employers are often protected when acting in good faith. That is why the details matter.

If something said about you is affecting your career, it may be worth taking a closer look.
