It’s a case that continues to hold the attention of the courts and the tax community. The Kwong case determined that during the COVID-19 disaster tax deadlines were extended, raising the potential for refunds of penalties and interest paid between 2020 and 2023. The IRS just appealed the case last week, but practitioners and taxpayers still need to consider action. While the issue remains in the courts, the window to file IRS claims for this period closes July 10, 2026. Partners Rebecca Sheppard and Peter Haukebo will walk through the latest developments related to the Kwong case and explain the steps needed to preserve valuable tax refund and abatement claims.
