Your 401(k) and IRA don't pass through your will, no matter what it says. They go to whoever's named on the beneficiary form, every time. That's good news. They skip probate, but only if the form is current.

Leave an old form never updated after a marriage, divorce, birth, or death, and the account goes somewhere you never intended. No valid beneficiary at all, and it can default to your estate and land in probate.
