In Florida, a wrongful death happens when someone dies because of another person’s negligence. A personal representative (PR) of the deceased’s estate files the claim on behalf of surviving family members, known as “survivors.”

According to data gathered by the Governors Highway Safety Administration (GHSA), in Florida in 2022, 824 pedestrians were killed in motor vehicle accidents, down 9 from the year before. Overall, there were more than 10,000 pedestrian accidents statewide. The Florida pedestrian fatality rate equates to 3.82 persons for every 100,000 in population, one of the highest rates in the nation.

A lone individual, or a group of individuals, struck by a vehicle weighing 3,000 pounds or more can result in devastating effects. It’s surprising that the fatality rate isn’t higher, but even minor injuries can lead to lifelong trauma and other emotional and physical challenges.

While some breeds of dogs such as pit bulls, Dobermans, and German shepherds have a controversial and notorious reputation for being aggressive, personal injuries from a dog attack can come from any breed of dog.

While dog owners are strictly liable for the damage caused by their dogs, there are some exceptions when it comes to bites. If the owner prominently displays a “BAD DOG” sign and the bite occurs on the owners property with such a sign, the owner will not be strictly liable to anyone who is 6 years or older. The owner can still be liable if he was negligent in any way that caused the dog to bite.

What is premises liability?

Florida law requires that anyone who owns or leases a property must keep it reasonably safe and warn visitors of any unreasonably dangerous conditions. Property owners are not responsible if you trip because of something unrelated to the property, like stepping on your own untied shoelace.

Typical premises liability accidents include injuries caused by wet or slippery surfaces, or where the walking elevation changes unexpectedly without warning. These injuries can result from a number of different accidents such as:

Slip and falls

Elevator and escalator accidents

Toxic fumes or chemicals

Swimming pool accidents

Mechanical malfunctions

Construction defects

Maintenance negligence
