In Georgia, before a DUI breath test can be administered, officers are required to conduct what's called a deprivation period — a continuous 20-minute window where the suspect cannot eat, drink, smoke, burp, or vomit. The reason? Mouth alcohol. Any residual alcohol in the oral cavity throws the reading off, and the machine can't distinguish it from deep lung air.
When I was reviewing DUI cases as a prosecutor, the deprivation period was one of the first things I looked at. If the documentation was missing or the timing was off, the breath result was vulnerable.
I've reviewed hundreds of these reports. It remains one of the most poorly documented steps in a DUI arrest. If it wasn't done right, that number on the report may not hold up the way the State wants it to.

Here's something most people facing a DUI never find out until it's too late.
The Walk-and-Turn field sobriety test doesn't start when you take your first step. It starts the moment you step into the heel-to-toe starting position — while the officer is still giving you instructions.
NHTSA, the federal agency that designed this test, actually scores swaying, stepping out of position, or using your arms to balance during the instruction phase as clues against you. So while you're trying to absorb a multi-step physical task, your balance is already being evaluated and written into a police report.
This isn't officer error. This is how the test is built.

If you've ever been through a DUI traffic stop — or just want to know what you'd actually be walking into — this is worth 45 seconds.
The first field sobriety test most officers run is called the HGN test, or the "eye test." An officer holds a pen or light about a foot from your face and moves it side to side. He's not watching whether your eyes look glazed. He's grading whether your eyes involuntarily jerk as they track.
That involuntary movement — called nystagmus — can be a sign of alcohol. It can also be caused by caffeine, certain medications, fatigue, or just how your eyes are built.
Six possible clues. Four or more — and in his report, you failed. You'll never know how you scored. He never tells you.
I spent years as a prosecutor in Cobb County and Fulton County watching officers administer these tests. Now I defend people on the other side of them.

Nobody told Marcus this about Georgia law. It cost him.
He was doing everything right on that bike. A car cut him off. He went down hard. And while he was in the ambulance, the insurance adjuster was already on the phone building a case against him.
