🏡 Georgia homeowners and HOA leaders—important changes are coming!
Governor Brian Kemp signed Senate Bill 406, the Georgia Property Owners’ Bill of Rights Act, on May 12, 2026.
Here are several key highlights:
âś… HOAs must register annually with the Georgia Secretary of State.
âś… Homeowners may file certain HOA complaints with the Secretary of State within 180 days of the alleged conduct.
âś… Homeowners gain greater rights to access association records, financial information and meetings.
âś… Payments must generally be applied to regular assessments first, followed by special assessments, specific assessments, and then other fees and fines.
✅ Before initiating foreclosure, the delinquent regular assessments must reach the lesser of $4,000 or 12 months of regular assessments—but not less than $2,000. Fines, fees and special assessments do not count toward that threshold.
âś… The foreclosure notice period increases from 30 to 60 days.
Most provisions take effect January 1, 2027. Provisions concerning the collection and review of attorney’s fees became effective July 1, 2026.
Whether you are a homeowner, board member or prospective buyer, understanding your rights and responsibilities can help protect your home and your community.
